May 4th, 1970 - Vietnam War: Kent State shootings – The Ohio National Guard, sent to Kent State University after the ROTC building was burnt down, opens fire on students protesting at the United States' invasion of Cambodia. Four students are killed, nine are wounded.

It was cutting in and out for me, too...

...so I went to the radio. Which is fine, except the local affiliate lops off Rachel's rear end (so to speak) for a state/local half-hour newscast.

It's really frustrating when Rachel's got a good rant going, or Kent's about to hit the punch line...and dead air happens.

I have a question about the Tongan Islands

Since Tonga is nation of 170 islands, how much of the Tongan islands are above sea level?

A Tsunami of 17 inches would really cause havoc on an island community that is only a few feet above sea level.

Is it just me

or is this site running really slow?

I read a couple pieces about D-Link flooding servers by always checking the time, as in Ebay and others, with their new time server software. It has effected many servers in Europe.

It might be something AAR should check into.

have made a showing for representation by coming out in peaceful protest it is time for 'legal' American workers to come out and remind their elected representatives the impact they have on the US economy if they didn't exist or were replaced not to forget cost of living wages to live on.

Say June 1st and 2nd or June 29th and 30th or July 3rd 4th and 5th etc.

What's good about Laura?

I have no problem criticizing the first lady. She's married to George W. Bush, apparently happily. That makes her a highly suspect person, if not downright hideous.

As for her baldfaced lies in that interview, isn't she showing the patented Bush contempt for her audience? Either that, or she's an idiot. There's nothing sacrosanct about her just because she SEEMS like a lady.

Follow up -- Moussaoui Jury, Dictionary, Verdict

A few days ago, TRMS questioned a ruling by the judge in the Moussaoui trial refusing a jury's request for a dictionary. At the time, I said she could have let the jury see a dictionary under the evidentiary doctrine of judicial notice, as long as the jury wasn't trying to use a dictionary to define a legal term of art.

Now, it's known that the jury wanted to consult a dictionary to define the word "aggravated." Aggravating factors to be considered during the penalty phase of trial are identified and defined by statutes and caselaw, and that makes them terms of art. The prosecutors and defense counsel filed tons of proposed jury instructions prior to sentencing phase, including jury instructions concerning aggravating factors. You can see these motions and arguments on the case docket at the website for the U.S. District Court for the Eastern District of Virginia:

Looks to me like the judge called it right. The jurors were supposed to rely on the jury instructions when deciding whether aggravating factors were present. Seems clear to me that dictionary definitions would have been improper.
