After a brief surge following the Sept. 11 attacks, government lawyers have declined to prosecute 2 out of every 3 terrorism-related cases brought to them by the FBI since 2001, according to a new study. This year the rate is even higher, with 91% of cases referred by law enforcement being dropped, with the cause most frequently cited as insufficient evidence or a lack of criminal intent on the part of the accused.
